Welcome to TrailBorn! The terms “we”, “us” and “our” refer to TrailBorn. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”) together with any policies referenced here describe your rights and responsibilities when you use the Services. 1. ACCESS AND ACCOUNT

  • We aim to display products accurately, but colours/appearance can vary by device and settings.
  • We do not warrant that any product will meet your expectations or precisely match on-screen appearance.

3. ORDERS

  • Your order is an offer to buy. We may accept or decline at our discretion. Acceptance occurs when we confirm it and process payment.
  • Review your order carefully; we may be unable to cancel after acceptance. If we change or cancel an order, we’ll try to notify you using the contact details provided.

  • You agree to provide accurate billing and promptly update payment details so we can complete transactions.
  • You warrant that you are authorised to use the payment method and will pay all charges, taxes, and fees.

5. SHIPPING AND DELIVERY

  • Delivery times are estimates only and not guaranteed. We’re not liable for carrier delays, customs processing, or events beyond our control.
  • Title and risk of loss pass to you when we hand the goods to the carrier.

6. INTELLECTUAL PROPERTY

  • The Services (trademarks, text, images, graphics, video, audio, design, and layout) are owned by TrailBorn or licensors and protected by applicable IP laws.
  • You may use the Services for personal, non-commercial use only. No reproduction, distribution, modification, public display, or derivative works without our prior written consent.
  • TrailBorn names, logos, and marks are our trademarks. Shopify’s names and marks are Shopify’s. Other marks belong to their owners. No rights are granted except as expressly stated.

7. OPTIONAL TOOLS

  • Third-party tools may be available “as is” and “as available” without warranties or endorsements. Use is at your own risk and subject to the third party’s terms.
  • Future features or tools are part of the Services and subject to these Terms.

8. THIRD-PARTY LINKS

  • The Services may link to third-party sites or content. We don’t control or endorse them and aren’t responsible for their content, policies, or practices. Access at your own risk.

9. RELATIONSHIP WITH SHOPIFY

  • Our store is powered by Shopify, enabling us to provide the Services. Sales are made directly between you and TrailBorn. Shopify isn’t responsible for any sale or issue between you and TrailBorn. You release Shopify and its affiliates from claims arising out of your purchases and transactions with TrailBorn.

10. PRIVACY

  • Because the Services are hosted by Shopify, certain data is processed by Shopify and its partners to provide and improve the platform. See our Privacy Policy for details.

11. FEEDBACK

Some jurisdictions don’t allow certain disclaimers; those may not apply to you.

16. LIMITATION OF LIABILITY

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILBORN AND ITS OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; OR FOR LOST PROFITS/REVENUE/SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.
  • Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

  • You agree to indemnify and hold harmless TrailBorn, Shopify, and our respective affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your: (1) breach of these Terms or referenced policies; (2) violation of law or third-party rights; or (3) use of the Services. We may control the defence/settlement of indemnified claims; you’ll cooperate as reasonably requested.

18. SEVERABILITY

  • If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remainder stays in effect.

19. WAIVER; ENTIRE AGREEMENT

  • Our failure to enforce a provision isn’t a waiver.
  • These Terms and posted policies are the entire agreement between you and TrailBorn regarding the Services and supersede prior understandings.

20. ASSIGNMENT

  • You may not assign or transfer these Terms without our prior written consent. We may assign or transfer without notice.

21. GOVERNING LAW

  • These Terms and any disputes arising out of or relating to them or the Services are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, subject to any consumer law rights that cannot be limited.

  • Headings are for convenience only and do not affect interpretation.

23. CHANGES TO THESE TERMS

  • We may update these Terms from time to time. We’ll post the revised version with an updated “Last updated” date and provide notice where required by law. Your continued use of the Services means you accept the changes.
